Declaration on the duty to provide information
The companies of the Chemgineering Group (hereinafter: "Chemgineering", "we" or "us") are particularly concerned about the protection of your personal data. We therefore process your data exclusively on the basis of current legal regulations (in particular the GDPR). In this data protection information we want to inform you about the key aspects of data processing on our website.

Cookies
Our website uses so-called cookies. These are small text files that are stored on the mobile device you are using the browser on. They are not damaging for your device.

We use cookies to make our website user-friendly. Some cookies remain stored on your device until you delete them. They enable us to recognize your browser the next time you visit us.

If you do not wish this, you can change  your browser settings to inform you whenever cookies are about to be stored. You can then decide to allow or disallow this for each individual case.

When cookies are disabled, the functionality of our website may be limited.

Web Analysis
Our website uses various functions of the web analysis service "Google Analytics Google LLC" ("Google"), Amphitheatre Parkway, Mountain View, CA 94043, USA. Cookies are used for this purpose, as they enable an analysis of the website use by your users. The information generated in this way is transferred to the provider's server and stored there.

You can prevent this by setting your browser refuse the storage of cookies on your device.

Google Analytics cookies contain your IP address. Google analytics uses the following data sources: user HTTP request, browser/system information, first-party cookies. We collect the following data using Google Analytics: language, geography, behavior (new vs. recurring), time history, visited chemgineering pages and dwell time, browser, network, information about mobile devices (telephone version), channels/sources that you have brought to our website and AdWords.

You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the browser plug-in available under the following link (http://tools.google.com/dlpage/gaoptout?hl=en). 

The data provided by Google Analytics is used to track and measure the use of this website so we can continue to produce appealing content. These cookies may track how long you stay on the site or the individual pages you visit, which helps us understand how we can improve the site for you.

We have concluded a corresponding contract with the provider for order data processing. Data collected via Google Analytics will be stored for 38 months.

Social Media Buttons
We also use social media buttons and/or plug-ins on our site that allow you to connect to your social network of choice in various ways. In order for these to work on the following social media sites, including Linkedin, Xing, Twitter, our website sets cookies that can be used to improve your profile on these web pages/services or to contribute to the data that these web pages/services store for various purposes defined in their respective privacy policies.

Contact with us
If you contact us through the form on our website or via e-mail, the data you provide will be stored on our servers for six months for the purpose of processing your enquiry and in the event of follow-up questions. We will not pass on this data without your consent.

Use of the data
If you enter into a contractual relationship with us, you disclose to us personal data and, if applicable, trade and business secrets of both you and your relatives, employees or other third parties. In all these cases, we assume that you are entitled to disclose this data. We use your data and the data of any such third parties provided by you to the extent necessary to properly establish and process our contractual relationship with you.

We will not process the data provided to us for purposes other than those covered by the project contract or by your consent or otherwise by a provision in accordance with the DSGVO.

Newsletter

Contents
Chemgineering sends out newsletters with advertising content to users who have expressly consented by registering and confirming their e-mail address.

The newsletters contain technical articles and event information as well as information on Chemgineering services.

Documentation of the application
The registration to our newsletter takes place only after confirmation of the e-mail address. After sending the registration form, we will send the recipient a double opt-in mailing with a confirmation link. Only by clicking the confirmation link, the registration takes place. 

To prove a valid consent date and time of the clicking of the confirmation link, the IP address of the calling user as well as the e-mail address of the receiver are stored together in a log file. In addition, a copy of the double opt-in mailing is stored and archived in an audit-proof manner.

Registration data of the user
The user's e-mail address is sufficient for registration. Voluntary details such as salutation, first name and surname are used exclusively for personalisation.

Evaluation of user behaviour
Chemgineering uses newsletter tracking in its newsletters and records recipient reactions and stores them anonymously for statistical purposes. It is not possible to draw conclusions about individual users from the stored data.

If the user expressly consents in advance, the recipient reactions are recorded and stored on a personal basis. This enables Chemgineering to better tailor the contents of the newsletter to the personal interests of the user.

Cancellation
The user can unsubscribe from the newsletter at any time and thus revoke his consent to receive the newsletter. Any consent to the collection of data on the personal usage behaviour of the newsletter which may be available shall also lapse.

The user has the possibility to carry out the newsletter himself at any time via the unsubscribe link contained in each newsletter.

The user also has the possibility to revoke at any time his consent to the recording and evaluation of personal user behaviour separately from his consent to the receipt of the newsletter via the revocation link contained in each newsletter.

Responsible for data processing

The applicant management of the Chemgineering Group is implemented by Chemgineering Technology GmbH, Kreuzberger Ring 13 in 65205 Wiesbaden. In this context, implementation is also being carried out for other companies in the Group. The company concerned is listed in the respective job advertisement. If you have any questions that are not answered or not clearly answered in this privacy policy, please contact career@chemginering.com. We will contact you as soon as possible.
 
Purposes of data processing
The Chemgineering Group and its individual companies collect and process your personal data for the purpose of your application for an employment relationship, insofar as this is necessary for the decision to establish an employment relationship with us. The legal basis is § 26 Paragraph 1 in conjunction with Paragraph 8 Sentence 2 BDSG.
 
Furthermore, we may process personal data about you insofar as this is necessary to defend against legal claims asserted against us in the application process. The legal basis for this is Art. 6 Para. 1, Letter f DSGVO; the legitimate interest is, for example, a duty of proof in proceedings under the General Equal Treatment Act (AGG).
 
Insofar as an employment relationship exists between you and us, we may process the personal data already received from you for the purposes of the employment relationship in accordance with Section 26 (1) BDSG if this is necessary for the performance or termination of the employment relationship or for exercising or fulfilling the rights and obligations of the employees' representation of interests resulting from a law or collective agreement (collective agreement).
 
Data processed
The Chemgineering Group processes data related to your application. This can be general data about you (such as name, address and contact data) and information about your professional knowledge and skills such as curriculum vitae, certificates, evaluations and communication data in accordance with § 88 (1) EU-DSGVO in conjunction with § 26 (1) BDSG (new). Furthermore, we may process job-related information made publicly available by you, such as a profile on professional social media networks.

Internal access to data
Within the group of companies, only the specific groups of persons and positions (e.g. human resources, specialist departments, management) receive your personal data which they require for the hiring decision and for the fulfilment of our pre-contractual and statutory obligations.
 
If you have applied for a position abroad, your application will also be forwarded to the specific groups of people and positions (e.g. human resources, specialist departments, management) on site in order to carry out the application procedure. Depending on the location, this may result in data being transferred to a country which, in the opinion of the EU Commission, does not have an adequate level of data protection. Personal data will only be passed on to third parties if you have expressly agreed to this or if data protection law permits this. Please note that your data will be forwarded within the group of companies to the company for which the position is to be filled. 
 
Duration of data storage
We store your personal data for as long as it is necessary to make a decision about your application. If an employment relationship between you and us does not materialize, we may also further store data, insofar as this is necessary to defend against possible legal claims. The application documents will be deleted six months after notification of the rejection decision, unless longer storage is required due to legal disputes.
 
If it turns out during the application process that we cannot promise you a specific position, you still have the possibility that we can consider your profile in the event of possible future vacancies. We will obtain the necessary consent from you separately by e-mail in due course. Please confirm them so that we can include you in our applicant pool. After successful admission to the applicant pool, we will store your data for a further 12 months. Your data will then be deleted automatically.
 
You have the possibility to revoke your consent to the use of your personal data at any time with effect for the future. All you need to do is send an e-mail to career@chemginering.com. A revocation results in the termination of the application procedure. You are responsible for the accuracy of the data you enter.

As an applicant at Chemgineering you have the following data protection rights, depending on the situation in individual cases, for the exercise of which you can contact us at any time via the e-mail address career@chemginering.com.


a. helpdesk
You have the right to obtain information about your personal data processed by us and to request access to your personal data and/or copies of these data. This includes information on the purpose of use, the category of data used, its recipients and authorised persons and, if possible, the planned duration of data storage or, if this is not possible, the criteria for determining this duration;
 
b. Correction, deletion or limitation of processing
You have the right to request us to correct any inaccurate personal data concerning you without delay. Taking into account the purposes of the processing, you have the right to request the completion of incomplete personal data - also by means of a supplementary declaration.
 
c. right of objection
Insofar as the processing of personal data concerning you is based on Art. 6 para 1 letter f DSGVO, you have the right to object to the processing of such data at any time for reasons arising from your particular situation. We will then no longer process this personal data unless we can prove compelling reasons worthy of protection for the processing, which outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
 
d. right of revocation
If the processing is based on consent, you have the right to revoke the consent at any time without affecting the legality of the processing carried out on the basis of the consent until revocation. To do so, you can contact us at any time via the e-mail address career@chemginering.com.
 
e. Right to cancellation
You have the right to request us to delete personal data concerning you immediately and we are obliged to delete personal data immediately if one of the following reasons applies:

  • the personal data is no longer necessary for the purposes for which they were collected or otherwise processed
  • you oppose the processing in accordance with point 8.c above and there are no overriding legitimate reasons for the processing.
  • The personal data have been processed unlawfully.
  • The deletion of personal data is necessary to fulfil a legal obligation under Union law or the law of the Member States to which we are subject.

This does not apply if processing is necessary:

  • to fulfil a legal obligation which processing requires under the law of the Union or of the Member States to which we are subject.
  • to assert, exercise or defend legal claims.

 
f. Right to limitation of processing
You have the right to request us to restrict processing if one of the following conditions is met:
the accuracy of your personal data is disputed, for a period that enables us to verify the accuracy of the personal data,
the processing is unlawful and you refuse to delete the personal data and instead request that the use of the personal data be restricted; we no longer need the personal data for the purposes of processing, but you do need them to assert, exercise or defend legal claims, or you have lodged an objection to the processing under point 8.c above until it has been determined whether our legitimate reasons outweigh yours.
 
Where processing has been restricted in accordance with this point (e), such personal data may only be processed - apart from being stored - with your consent or for the purpose of asserting, exercising or defending rights or protecting the rights of another natural or legal person or on grounds of an important public interest of the Union or a Member State. If you have obtained a restriction on processing, we will inform you before the restriction is lifted.
 
g. right of appeal
Without prejudice to any other administrative or judicial remedy, you have the right of appeal to a supervisory authority, in particular in the Member State where you are staying, working or suspected of infringing, if you believe that the processing of personal data concerning you is contrary to the DSGVO.
 
Necessity of providing personal data
The provision of personal data is neither required by law nor by contract, nor are you obliged to provide the personal data. However, the provision of personal data is required for a contract of employment with one of the companies of the Chemgineering Group. This means that if you do not provide us with any personal data in an application, we will not enter into an employment relationship with you.

Your Rights

In principle, you have the rights to information, correction, deletion, restriction, data transferability, revocation and objection. If you believe that the processing of your data violates data protection law or your data protection claims have otherwise been violated in any way, you may complain to the supervisory authority.
